Terms and conditions

General Provisions.
This document is a formal proposal of the Organizer to individuals to enter into a contract for entertainment games and to book the premises and accessories required to this end for the period of entertainment activities.
This document is a public offer.
There is a special procedure of entering into a standard-form contract, by means of accepting this offer, which contains all the material terms and conditions of the contract, without being signed by the parties. Accepting an offer is in lieu of entering into a contract under the terms and conditions as set forth in the offer.
The acceptance of the terms and conditions set forth below shall be confirmed by the Customer’s sending a Booking Order for Premises.
The person sending the Order shall be deemed to be the Customer or the duly authorized Customer’s Representative. The Customer and the Organizer are hereinafter jointly referred to as the Parties to this Contract.
This Contract shall be deemed to have been entered into at the time of acceptance of the offer and shall remain valid until the full performance thereof by the parties.

1.1. As used herein, the following terms shall have the following meaning:
Booking is the Customer’s purchasing the Organizer’s services to exercise the Customer’s right to use the Premises and lease the Accessories and receive the Quest Organizer’s Assistance to hold the Quest within the within the timeframe and on terms and conditions as specified by the Organizer subject to the Rules of the Game.
Order is a duly registered and formulated Customer’s request to receive the Quest Organizer’s services selected through the Website by filling out a form in the Personal Account section. The rules of making an Order are provided on the Website and may be different subject to the type of the Quest.
Accessories are assets stored in the Premises booked for the Quest selected by the Customer.
Website is a resource found on the Internet athttp://phobia.ru/ where the information about the services is displayed. The Website enables the Customer to use the Internet to interact with the booking system for premises and accessories for the desired time, locations, and type of the Quest (Session), including the possibility to receive the descriptions, images, availability data, terms and conditions, as well as prices for Premises and Accessories Booking.
Contract is this <nobr>standard-form</nobr> contract entered into by means of accepting this offer between the Quest Organizer and the Customer for booking the Premises and the Accessories and holding the Quest.
Quest is an entertainment game held in the Premises using the Accessories which starts at an hour as specified in the schedule and lasts for a specified continuous period of time following the scenario and terms and conditions as set forth by the Organizer, including but not limited to requirements to the age, composition of the Quest teams and number of participants (not more and not less than the admissible number of participants as specified on the website), health and physical condition restrictions (as to the unacceptability of the Quest participants’ being under the influence of alcohol or drugs or health conditions which prevent them from participation in the Quest), subject to the terms and conditions of a specific Quest. The type and time of the Quest shall be defined based on the schedule provided on the Website.
Customer is a legally capable person meeting the Organizer’s requirements to the Quest participants who accepted the offer and by doing so purchases the Quest Organizer’s services to book the Premises and hold the Quest.
Organizer is a legal entity that provides customer service for booking the Premises and the Accessories and holding the Quest at a specified hour and for a specified period of time as indicated by the Customer in the Order based on the schedule of the Quest type concerned.
Premises are real estate at the Organizer’s disposal which is specifically equipped with the Accessories intended for holding the Quest.
Rules of the Game are requirements set out for the Quest participants and provided in the respective section of the Website, including but not limited to requirements to the number of participants and composition of teams, their age, health condition (including not being under the influence of alcohol and/or drugs). Additional requirements may be set by the Organizer depending on the type of the Quest.
Session is an event where the Quest is held over a specified continuous period of time, at a specified location, at a specified hour, and has a specified duration.
1.2. This text may also contain terms which are not referred to by the above definitions. The text of the offer and common sense shall be taken into account when interpreting such terms.
The Subject Matter of the Contract
2.1. The Organizer undertakes to provide the Customer with services for Booking the Premises for the Session, as well as for organizing and holding the Quest.
2.2. The Customer selects the Quest, books the Premises for the Session and the Quest organization services strictly in line with the terms and conditions provided on the Website, while the Organizer receives payment for Booking the Premises and the Accessories, organizing and holding the Quest specified in the Order.
2.3. The Organizer undertakes to Book the Premises and the Accessories for the Quests pursuant to the procedures and terms set forth in this Contract.
2.4. This public offer shall be deemed to be accepted (entered into) at the time of the Customer’s creating, registering, and sending the Order as provided in this Contract through the Personal Account section on the Website. The Customer and the Organizer thereby confirm their agreement to the terms and conditions of the Contract whereafter this Contract shall be deemed to be the basic document governing the official relationship between the Customer and the Organizer.
Terms and Procedures for the Supply of Services
3.1. The charges of services for booking the Premises and the Accessories for the Sessions and services for organizing and holding the Quests are provided on the Website and may be changed by the Organizer. The Services are paid for according to the prices provided on the Website.
3.2. The Organizer warrants that as of the date of the Session for which the Premises and the Accessories have been booked as indicated on the Website the Organizer has all the rights to the Premises and the Accessories as required for holding the Quest.
3.3. The Organizer reserves the right to refuse to provide the booking services to the Customer should the Customer fail to meet the requirements set out in paragraph 2 of this Contract. The terms and conditions under which the Organizer may refuse to provide the booking services and holding the Quest are set out in the Rules of the Game section of the Website.
3.4. Services Supply Procedure:
3.4.1. Booking shall be deemed to be completed after all of the following procedures have been performed:
— Selecting the Quest time and type suitable for the Customer (Player) on the Website and sending the Order to the Organizer,
— Selecting the payment option suitable for the Customer: in person at the Organizer’s office, in cash to the Organizer’s courier when purchasing the Certificate, or by means of electronic payment systems.
— Upon receiving the complete Order and completing the Booking procedure, the Organizer notifies the Customer of having booked the Premises for the Quest time and type as chosen by the Customer by sending an email to the email address provided by the Customer.
— The Customer’s making a 100% advance service payment equal to the Quest price as indicated on the Website. Booking charges paid by the Customer shall be returned provided the Customer observes the term of the Booking cancellation specified in paragraph 3.4.2. of this Contract. Should the Customer violate the term of the Booking cancellation, the Organizer may charge a penalty as set forth in paragraph 8.2. of this Contract.
3.4.2. Booking shall be deemed to be cancelled as follows:
— no later than 48 (forty eight) hours before the Quest the Customer may cancel the Booking by serving a corresponding notice to the Customer by means of clicking on the Cancel Session link in the Personal Account section of the Website. The date and time of the Booking cancellation shall be the date and time when the Organizer receives the Customer’s information.
3.5. The Customer Booking and Service Orders shall be processed upon the Organizer’s receiving the corresponding form completed by the Customer in the Personal Account section of the Website. The Order processing time shall not exceed 24 (twenty four) hours upon the Customer’s registration of the Order in the Personal Account section.
Rights and Obligations of the Parties.
4.1. The Organizer may:
— refuse to book the Premises and hold the Quest for the Customer, should the Customer violate the terms of the Booking completion set forth in this offer,
— redirect the Customer to the Internet payment system to effect the payment,
— refuse to provide access to the Quest Premises to the Customer, should the Customer violate the rules of participation in the Quest set forth in this Contract and provided in the Rules of the Game section on the Website, and charge a penalty in the amount and following the procedure set forth in paragraph 8.2. of this Contract.
4.2 The Organizer undertakes:
— to provide the Customer with all required Quest information, including the descriptions, images, maximum and minimum admissible number of Quest participants, to formulate requirements to the participants, their age, physical and health condition, and provide information about the Booking charges and rules of the Booking cancellation,
— to inform the Customer about the status of the Booking documents. The Customer shall be deemed to be informed after a confirmation email and/or a text message has been sent to the email address and/or mobile number provided by the Customer,
— to settle any duly justified Customer’s complaints of inadequate quality of Organizer’s services relating to the Booking of the Premises and to making the Quest accessible for the Customer, using the Organizer’s own resources and at his own expense,
— reply to the Customer’s requests sent in writing or by electronic means within 1 (one) business day,
— take all reasonable measures to ensure the security of the Customer’s personal data.
4.3. The Customer may:
— take independent decisions to use the Booking service on the Website. The Customer acknowledges that by using the Website and sending the Order the Customer fully and expressly accepts the terms and conditions of the offer and enters into the Contract,
— require that the Organizer confirm in writing (via an email and/or a text message sent to the email address and/or the mobile number provided by the Customer) that the Booking Order has been sent,
— contact the Organizer’s helpdesk using the contact information provided on the Website,
— provide feedback on the Organizer’s performance on the Website.
4.4. The Customer undertakes:
— to read and acknowledge all rules of service use provided on the Website,
— to agree that upon sending the Order, performing the Booking, and completing the Booking, the Customer has accepted the offer and become a party to this Contract, with all rights and duties arising therefrom,
— to book the Premises and the Accessories for the Session subject to the terms and conditions of this offer and the Organizer’s requirements,
— to fully pay the Booking charges using any of the payment methods set forth in paragraph 6 of this Contract,
— to provide information to the Organizer which is deemed to be necessary and sufficient for the Booking, as well as any other information which is deemed necessary for the performance by the parties of contractual obligations hereunder, and to be held fully responsible for this information. The Customer confirms the validity of personal data provided on the Website, is held fully liable for their accuracy, completeness, and validity, and agrees to them being processed,
— to accept the risk of adverse effects in case of invalidity of the data provided in the Order,
— to be bound by the terms and conditions of this Contract.
Settlements and Terms of Payment
5.1. Payment for the Booking of the Premises and the Accessories for the Session and for the services for organizing and holding the Quest subject to the schedule and requirements provided on the Website shall be effected by making a 100% advance payment in the amount specified in the Website section describing the Quest selected by the Customer. The payment due date is set by the Organizer and is communicated to the Customer when completing the Order form in the Personal Account section of the Website.
5.2. Payment can be made using one of the following payment methods:
— in cash at the Organizer’s cashier’s desk,
— by transferring the required amount to the Organizer’s account using payment systems.
5.3. Should the Customer violate the Rules of the Game set forth by the Organizer and therefore be unable to participate in the Quest, the Organizer may charge the Customer a penalty for the idle time of the Premises and the Accessories and the cancellation of the Session through the fault of the Customer subject to paragraph 8.2. of this Contract.
Special Provisions.
6.1. The Order may be drawn up by registered Customers only. The Customer may get registered on the website only 1 (one) time, i.e. the Customer may have only one Personal Account. The Organizer shall not be held liable for the accuracy and validity of information provided by the Customer during registration. The Customer who has got registered on the website is assigned individual identification by providing a login and a password. The Customer’s individual identifications helps avoid the unsanctioned actions of a third party that may be taken on the Customer’s behalf and provides access to additional services. The Customer shall be held personally liable for any negative consequences that may arise when the login and the password are disclosed to third parties.
6.2. The Customer is not required to provide personal data when completing the Order. The Customer shall be identified only by providing a login, an email address and/or a mobile number. In the event that the data provided are recognized to be personal data subject to the current legislation, the Organizer undertakes to employ the personal data of the Customer and/or persons named by the Customer which are used for the registration of the Order with the sole purpose of booking the Premises for the Session for customer identification and support. The Organizer undertakes not to use the personal data of the Customer and persons named by the Customer for any unlawful distribution of materials not relating to the Orders and not to provide the data and information to third parties, except as under an effective judgment of court.
6.3. When accepting this offer, the Customer hereby gives his unconditional consent to receiving a notice to the email address or mobile number provided by the Customer.
Liability of the Organizer and the Customer.
7.1. The Organizer and the Customer shall be held liable for the failure to perform or for undue performance of their obligations hereunder subject to the terms and conditions of this offer and the current legislation.
7.2. Should the Customer refuse to hold the Quest following the period of time specified in paragraph 3.4.2., or violate the Quest terms and the Rules of the Game provided on the Website for each Quest (e.g., failure to meet the Organizer’s requirements to the number of players and composition of teams, their age, physical and health condition, including not being under the influence of alcohol and/or drugs, other Quest requirements), or violate the terms and conditions of this Contract, the Organizer may charge the Customer a penalty amounting to 100% of the price of the Quest Booking for the idle time of the Premises and the Accessories. The penalty amount may be deducted by the Organizer from the amount of Booking charges paid by the Customer. The Organizer shall notify the Customer thereof by sending an email to the email address provided by the Customer in the Booking Order.
7.3. The Organizer shall not be held liable for any failure to supply services to the Customer through the Website caused by technical problems, including any failure of the communication lines, equipment failure, etc.
7.4. In the event of any failure to organize and hold the Quest, as well as in the event of undue organization of the Quest through the Organizer’s fault, the advance payment amount deposited for the Booking shall be repaid to the Customer in full.
7.5. The Organizer shall not be held liable for any violation of terms and conditions of this Contract caused by force majeure events, including government actions, fires, floods, earthquakes, other acts of God, failure of power supply and/or computer network, strikes, riots, protests, and any other events beyond the reasonable control of the Organizer that might prevent the Organizer from performing his obligations hereunder.
7.6. The Organizer shall not be held liable and shall not compensate the Customer for any expenses caused by the Organizer’s failure to perform his obligations due to insurmountable obstacles arising out of the actions of government or any third persons, including failure to perform the Organizer’s obligations caused by the Customer’s failure to meet the requirements to his and his team’s participation in the Quest, including requirements to age, number of Quest participants (not more and not less than the number of participants as specified on the Website), health and physical condition restrictions as to the unacceptability of the Quest participants’ being under the influence of alcohol or drugs or health conditions which prevent them from participation in the Quest.
7.7. Any dispute arising out of or in connection with this Contract initiated by the Customer shall be referred to the corresponding court at the location of the Organizer’s registered office following the dispute settlement procedure. Written complaints shall be sent to the Organizer’s email address provided on the Website within 1 (one) calendar day of the service provision (of the Quest). All claims shall be answered within 15 (fifteen) calendar days after the complaint has been received by the Organizer.
Public Offer Modification and Termination Procedure
8.1. The Organizer reserves the right to modify the terms and conditions of this offer at any time. In the event that the effective date of the amendments is not specifically provided, the amendments shall take effect as of the date of their publication on the Website.
8.2. The Customer’s using the Website following the modification of the public offer is expressly understood by the Organizer as acceptance of the modifications.
8.3. The Contract entered into by accepting this offer may be terminated at any time on the Customer’s part by serving the Organizer a notice as set forth in paragraph 3.4.2. hereof no later than 48 (forty eight) hours prior to the Customer’s arrival at the Premises Booked for the Quest.
8.4. Should the Customer violate the Booking procedure and terms set forth in this Contract, the Contract shall be deemed null and void.
Contract Duration
This Contract shall take effect on the date of its signing (acceptance of the offer) and shall remain valid until the full performance thereof by the parties.
